Terms of Use

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (you) and Shanti Business School (the Company, we, us, or our), concerning your access to and use of the shantibschool.edu.in website and any related media form, media channel, mobile website, or mobile application (collectively, the Site). We are registered in India and have our registered office at Shela Off S.P. Ring Road, Opp. Vraj Gardens, Ahmedabad, Gujarat 380058. By accessing the Site, you agree that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with all of these Terms, you must discontinue use of the Site immediately.

Supplemental terms and conditions or documents posted on the Site are incorporated by reference. We may change these Terms at any time and for any reason. We will notify you of changes by updating the Last updated date. Please check the applicable Terms each time you use the Site. Continued use after revised Terms are posted means you accept those changes.

The information on the Site is not intended for distribution or use where it would violate local laws or regulations or subject us to registration requirements. If you access the Site from another location, you do so on your own initiative and are responsible for compliance with applicable local laws.

The Site is intended for users at least 13 years old. Minors must have permission from and be directly supervised by a parent or guardian. If you are a minor, your parent or guardian must read and agree to these Terms before you use the Site.

Unless otherwise indicated, the Site is our proprietary property. Its source code, databases, functionality, software, designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos are owned or controlled by us or licensed to us, and are protected by applicable intellectual-property laws. Site content and marks are provided as-is for your information and personal use. Except as expressly provided in these Terms, no part of the Site or its content may be copied, reproduced, republished, uploaded, posted, displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for commercial purposes without our prior written permission.

If you are eligible to use the Site, you receive a limited licence to access and use it and to download or print content you have properly accessed solely for personal, non-commercial use. We reserve all rights not expressly granted to you.

By using the Site, you represent and warrant that information you submit is true, accurate, current, and complete; that you will keep it up to date; that you have legal capacity to agree to these Terms; that you meet the applicable age requirements or have parental permission; that you will not access the Site using automated or non-human means; that you will not use the Site for illegal or unauthorised purposes; and that your use will not violate applicable law or regulation.

If you provide information that is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse current or future use of the Site or any portion of it.

You may be required to register with the Site. You agree to keep your password confidential and are responsible for all use of your account and password. We may remove, reclaim, or change a username if, in our sole discretion, it is inappropriate, obscene, or otherwise objectionable.

You may not access or use the Site for any purpose other than that for which we make it available. The Site may not be used for commercial endeavours unless specifically endorsed or approved by us. As a user, you agree not to:

1. Systematically retrieve Site data or content to create or compile a collection, database, or directory without our written permission. 2. Trick, defraud, or mislead us or other users, particularly to obtain sensitive account information such as passwords. 3. Circumvent, disable, or interfere with Site security features or limitations on the use or copying of content. 4. Disparage, tarnish, or otherwise harm us or the Site. 5. Use Site information to harass, abuse, or harm another person. 6. Improperly use support services or submit false reports of abuse or misconduct. 7. Use the Site inconsistently with applicable laws or regulations. 8. Engage in unauthorised framing of or linking to the Site. 9. Upload or transmit viruses, Trojan horses, spam, or other material that interferes with others’ use of the Site or its features, functions, operation, or maintenance. 10. Use automated systems, data mining, robots, or similar data-gathering and extraction tools. 11. Delete copyright or other proprietary-rights notices from Site content. 12. Impersonate another user or person or use another user’s username. 13. Upload or transmit material that acts as an information-collection or transmission mechanism, including clear GIFs, 1x1 pixels, web bugs, cookies, spyware, or similar devices. 14. Interfere with, disrupt, or create an undue burden on the Site or connected networks and services. 15. Harass, annoy, intimidate, or threaten employees or agents providing any part of the Site. 16. Bypass measures designed to prevent or restrict access to the Site or any part of it. 17. Copy or adapt the Site’s software, including Flash, PHP, HTML, JavaScript, or other code. 18. Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer Site software. 19. Except for standard search-engine or browser use, use, launch, develop, or distribute automated systems such as spiders, robots, scrapers, or offline readers, or launch unauthorised scripts or software. 20. Use a buying or purchasing agent to make purchases on the Site. 21. Make unauthorised use of the Site, collect usernames or email addresses to send unsolicited email, or create accounts by automated means or under false pretences. 22. Use the Site or its content to compete with us or for a revenue-generating endeavour or commercial enterprise. 23. Disregard that this is an educational website. Users must be at least 13 years old; minors must have permission from and be supervised by a parent or guardian, who must agree to these Terms.

The Site does not offer users the ability to submit or post content. We may provide opportunities to create, submit, post, display, transmit, publish, distribute, or broadcast materials such as text, video, audio, photographs, graphics, comments, suggestions, or personal information (Contributions). Contributions may be viewable by other users or through third-party websites and may be treated under the Site Privacy Policy. When making Contributions, you represent and warrant that:

1. Your Contributions and their use do not infringe another party’s copyright, patent, trademark, trade secret, moral, or other proprietary rights. 2. You own your Contributions or have the licences, rights, consents, releases, and permissions needed to submit them and authorise their use as contemplated by the Site and these Terms. 3. You have written consent from identifiable people in your Contributions to use their names or likenesses as contemplated by the Site and these Terms. 4. Your Contributions are not false, inaccurate, or misleading. 5. Your Contributions are not unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other solicitation. 6. Your Contributions are not obscene, violent, harassing, libellous, slanderous, or otherwise objectionable. 7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone. 8. Your Contributions are not used to harass or threaten another person or promote violence against a person or class of people. 9. Your Contributions do not violate any applicable law, regulation, or rule. 10. Your Contributions do not violate the privacy or publicity rights of a third party. 11. Your Contributions do not violate laws concerning child pornography or the health or well-being of minors. 12. Your Contributions do not include offensive comments connected to race, national origin, gender, sexual preference, or physical handicap. 13. Your Contributions do not otherwise violate these Terms or applicable law, and do not link to material that does.

Use of the Site in violation of these requirements violates these Terms and may result in termination or suspension of your right to use the Site.

You agree that we may access, store, process, and use information and personal data you provide in accordance with the Privacy Policy and your choices, including settings.

By submitting suggestions or other feedback about the Site, you agree that we may use and share that feedback for any purpose without compensation.

We do not claim ownership of your Contributions. You retain ownership and associated intellectual-property or proprietary rights. You are solely responsible for your Contributions and agree to release us from responsibility and refrain from legal action against us regarding them.

Questions, comments, suggestions, ideas, feedback, or other information you provide about the Site (Submissions) are non-confidential and become our sole property. We own exclusive rights, including intellectual-property rights, and may use and disseminate Submissions without restriction for any lawful purpose, commercial or otherwise, without acknowledgement or compensation. You waive moral rights in Submissions and warrant that they are original to you or that you have the right to submit them. You agree there is no recourse against us for alleged or actual infringement or misappropriation of a proprietary right in your Submissions.

We reserve the right, but not the obligation, to monitor the Site for violations; take appropriate legal action against anyone who violates the law or these Terms; refuse, restrict, or disable access to Contributions or any portion of them; remove or disable files and content that are excessive in size or burdensome to our systems; and otherwise manage the Site to protect our rights and property and facilitate its proper functioning.

We care about data privacy and security. By using the Site, you agree to be bound by the Privacy Policy posted on it, which is incorporated into these Terms. The Site is hosted in India. If you access it from another region with different personal-data laws or requirements, continued use of the Site transfers your data to India, and you agree to that transfer and processing.

These Terms remain in full force while you use the Site. Without limiting any other provision, we may, in our sole discretion and without notice or liability, deny access to or use of the Site to any person for any reason, including breach of a representation, warranty, covenant, or applicable law. We may terminate your use or participation or delete your account and posted information at any time, without warning, in our sole discretion.

If your account is terminated or suspended, you may not register or create another account under your name, a fake or borrowed name, or a third party’s name, even if acting on that party’s behalf. We may also pursue appropriate civil, criminal, or injunctive remedies.

We may change, modify, or remove Site content at any time for any reason without notice, and have no obligation to update information. We may modify or discontinue all or part of the Site without notice and are not liable for any modification, price change, suspension, or discontinuance.

We cannot guarantee the Site will always be available. Hardware, software, or other problems and maintenance may cause interruptions, delays, or errors. We may change, revise, update, suspend, discontinue, or otherwise modify the Site at any time without notice. We are not liable for loss, damage, or inconvenience caused by inability to access or use the Site during downtime. Nothing in these Terms obligates us to maintain or support the Site or provide corrections, updates, or releases.

These Terms are governed by the laws of India. Shanti Business School and you irrevocably consent that the courts of India have exclusive jurisdiction to resolve disputes arising in connection with these Terms.

You agree to submit disputes related to these Terms or the relationship established by this Agreement to the jurisdiction of the courts of India. Shanti Business School also retains the right to bring proceedings on the substance of a matter in the courts of the country where you reside or, if these Terms are entered into in the course of your trade or profession, the state of your principal place of business.

Information on the Site may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and other information. We may correct errors, inaccuracies, or omissions and change or update information on the Site at any time without prior notice.

The Site is provided on an as-is and as-available basis. Your use of the Site and our services is at your sole risk. To the fullest extent permitted by law, we disclaim express and implied warranties relating to the Site and your use of it, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about the accuracy or completeness of Site content or linked websites and assume no liability for content errors; personal injury or property damage resulting from access or use; unauthorised access to secure servers or personal or financial information; interruption of transmissions; bugs, viruses, or similar material transmitted by third parties; or loss or damage resulting from content made available through the Site.

We do not warrant, endorse, guarantee, or assume responsibility for products or services advertised or offered by third parties through the Site or linked websites. We are not responsible for monitoring transactions between you and third-party providers. Use your best judgement and exercise caution when purchasing products or services.

In no event will we or our directors, employees, or agents be liable to you or a third party for direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless Shanti Business School, its subsidiaries and affiliates, and their officers, agents, partners, and employees from any loss, damage, liability, claim, or demand, including reasonable legal fees and expenses, made by a third party due to or arising from your use of the Site; breach of these Terms or your representations and warranties; violation of a third party’s rights, including intellectual-property rights; or a harmful act toward another user with whom you connected through the Site. At your expense, we may assume the exclusive defence and control of a matter for which you must indemnify us, and you agree to cooperate with that defence. We will use reasonable efforts to notify you of such a claim, action, or proceeding after becoming aware of it.

We maintain certain data you transmit to the Site to manage its performance, as well as data relating to your use. Although we perform routine backups, you are solely responsible for all data you transmit or that relates to your activity on the Site. We have no liability for loss or corruption of such data, and you waive any right of action arising from that loss or corruption.

Visiting the Site, emailing us, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that agreements, notices, disclosures, and other communications provided electronically, by email, or on the Site satisfy legal requirements that communications be in writing.

You agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and transaction records initiated or completed by us or through the Site. You waive rights or requirements under laws in any jurisdiction that require original signatures, delivery or retention of non-electronic records, or payments or credits by non-electronic means.

These Terms and any policies or operating rules posted by us on or in respect of the Site constitute the entire agreement between you and us. Our failure to exercise or enforce a right or provision is not a waiver. These Terms operate to the fullest extent permitted by law. We may assign any or all of our rights and obligations at any time and are not responsible for loss, damage, delay, or failure to act caused by events beyond our reasonable control.

If any provision is unlawful, void, or unenforceable, it is severable and does not affect the validity of the remaining provisions. Use of the Site creates no joint venture, partnership, employment, or agency relationship between you and us. You agree these Terms will not be construed against us because we drafted them, and waive defences based on their electronic form or the lack of signatures by the parties.
